HARLINGEN, TX – A road rage incident in Cameron County on Tuesday morning left two men hospitalized after a driver fired a handgun while allegedly being assaulted on the roadside.

Deputies with the Cameron County Sheriff’s Office responded around 7:30 a.m. to the intersection of FM 508 and FM 509 following reports of a shooting involving multiple individuals.

As reported by Valley Central, the confrontation involved two brothers driving separate vehicles and another driver who had his two young children inside his vehicle at the time.

According to investigators, the driver told deputies he was traveling westbound on FM 508 with his nine and ten year old children when he passed two vehicles. Authorities said the maneuver nearly caused one of those vehicles to veer off the roadway.

The sheriff’s office said both vehicles then began following the driver and signaling for him to pull over. The driver told deputies he eventually stopped and exited his truck.

Investigators say the situation quickly turned physical. The driver told deputies the two men began assaulting him after he stepped out of the vehicle.

During the altercation, the driver retrieved a handgun from his center console and fired while the alleged assault continued. Authorities later recovered a .40 caliber handgun along with several spent shell casings at the scene.

Both men who were shot were transported to a local hospital. One suffered gunshot wounds to the forearm and armpit area, while the other was shot in the stomach. Officials said both men were listed in stable condition.

The driver also sustained significant injuries during the incident. According to the sheriff’s office, he suffered trauma to his eye socket along with multiple bumps and lacerations to his head and face.

Authorities have not said whether the children inside the vehicle were injured. No arrests had been made as of the latest report while investigators continue reviewing the circumstances surrounding the shooting.

Road rage situations can escalate quickly, and encounters that begin as traffic disputes can turn dangerous in a matter of seconds. When possible, avoiding roadside confrontations altogether and continuing to a safe location such as a police station, especially when children are present.

However, once a physical assault begins, the situation can change rapidly. Multiple attackers can create what is known as a disparity of force, where the victim may reasonably fear serious bodily harm even if the attackers are not armed with a firearm.

The right to armed self defense exists for situations where a person is facing an immediate and violent threat with no safe way to disengage. As the investigation continues, authorities will likely focus on whether the driver reasonably believed deadly force was necessary to stop the assault.
